UPTask (“UPTask,” “we,” “us,” or “our”) is a marketplace and lead‑generation platform that connects Clients with independent Technicians/handymen. For safety, fraud prevention, and compliance, UPTask may procure background checks on Technician applicants and, in some cases, on an ongoing basis for active Technicians (“you”). UPTask is not an employer and this process is not employment screening; however, background checks may be obtained for a purpose permitted by the Fair Credit Reporting Act (15 U.S.C. §1681 et seq.) and similar state laws.
A. Standalone Disclosure (FCRA)
UPTask may obtain one or more consumer reports and/or investigative consumer reports about you from a consumer reporting agency for contractor onboarding, platform access, safety, fraud prevention, identity verification, and related purposes permitted by law. These reports may include information about your criminal history, sex‑offender registry status, motor vehicle/driving records, identity and address history, prior professional experience, education, licensing/insurance status, sanctions/watchlists, and other relevant public records. For investigative consumer reports, information may be obtained through personal or professional interviews.
We use Checkr, Inc. (“Checkr”) as our background screening provider to obtain and process these reports on our behalf.
B. Authorization & Continuing Consent (via Registration Checkbox)
By creating an account and checking the consent box during UPTask registration (your electronic authorization), you:
- Authorize UPTask to obtain consumer reports and investigative consumer reports about you now and at any time during your active access to the platform, including periodic re‑screens and/or continuous monitoring where permitted by law.
- Authorize Checkr and other consumer reporting agencies and data furnishers to disclose such information to UPTask for the purposes described above.
- Acknowledge that UPTask may decline, suspend, or terminate platform access based on background check results without providing detailed reasons, subject to legally required pre‑adverse and adverse action notices (including a copy of the report and the FCRA Summary of Rights).
- Acknowledge that UPTask is not your employer; you are an independent contractor responsible for taxes and regulatory obligations.
- Agree that you will not receive leads or job offers until screening is satisfactorily completed.
- Certify that the information you provide during onboarding is true and accurate. Misrepresentation or failure to maintain required licenses or insurance may result in denial or removal from the platform.
C. Data Handling & Privacy
- Processing by Checkr. Background check processing (collection of source data, report creation, retention) is performed by Checkr as our service provider.
- Report Storage. UPTask does not store full background check reports. We may retain limited metadata such as screening status (e.g., Clear/Consider), timestamps, and required notices or adjudication records to comply with law, resolve disputes, and maintain platform safety.
- Your Rights. You may request a copy of your report, dispute inaccuracies, or exercise other rights directly with Checkr or via links provided in UPTask’s pre‑adverse/adverse action notices. You may also contact privacy@uptask.io for assistance.

D. State & Local Notices
Certain jurisdictions require additional disclosures and rights notices (e.g., California, New York). Where applicable, UPTask will provide you with the required state‑specific notices (such as California’s Investigative Consumer Reporting Agencies Act notice and New York Article 23‑A). Please review any attached or linked notices before providing authorization.
E. Electronic Records & Signature (E‑Sign Consent)
You agree to receive disclosures and provide your authorization electronically. You may withdraw consent or request paper copies by contacting support@uptask.io; withdrawal may affect your ability to use the platform.
F. Electronic Authorization (Checkbox/E‑Sign)
By checking the consent box and selecting “Continue”, you provide your electronic signature and agree that UPTask may obtain consumer reports and investigative consumer reports about you from Checkr, Inc. (and other consumer reporting agencies) now and at any time during your active access to the platform for onboarding, safety, fraud prevention, and related lawful purposes. You understand that:
- UPTask may deny, suspend, or terminate platform access based on background check results without providing detailed reasons, subject to any legally required pre‑adverse/adverse action notices (including a copy of the report and the FCRA Summary of Rights).
- You will not receive leads or job offers until screening is satisfactorily completed.
- UPTask does not store full background reports; Checkr processes the screening. UPTask may retain status metadata (e.g., Clear/Consider), timestamps, and notices as required by law.
- You consent to receive all disclosures and notices electronically and may request paper copies or withdraw e‑sign consent by contacting support@uptask.io (withdrawal may affect your ability to use the platform).
Checkbox text (for UI):
“I authorize UPTask to obtain consumer reports/investigative consumer reports about me from Checkr for onboarding and safety, now and during my active use of the platform. I acknowledge I have received the Standalone Disclosure and the FCRA Summary of Rights and understand access may be denied without detailed reasons.“
Recordkeeping (recommended): store user ID, full name, timestamp, IP/device, consent version hash, and a PDF/HTML copy of the disclosure presented at time of consent.
G. No Separate Signature Required
Consent for background screening is captured solely via the registration checkbox and your act of creating an account. No additional written or third‑party signature is required.
